Understanding Collaborative Law
Resolving your divorce through the "collaborative law" process is far different from traditional divorce proceedings. In the collaborative law methodology, the parties and their lawyers strive to reach an agreement outside of the court system. Your divorce will not be dictated by a court calendar. The process is informal and free of the adversarial nature of the courtroom.
A key element of a collaborative divorce is that the lawyers first contractually agree not to file divorce proceedings. The parties share all information informally and completely, through the guidance of each of their trained collaborative attorneys. You and your spouse will keep control of the key decisions in your divorce, rather than giving that power to a judge or a neutral third party. Together, we jointly strive to develop an agreement regarding all aspects of your divorce, including:
- Child custody or shared parenting plan
- Child support, if appropriate
